Previously, we have highlighted the Malaysia Competition Commission (“MyCC”)’s intense efforts in investigating suspected bid rigging activities in Malaysia following its revelation that it is investigating 500 companies suspected of being involved in rigging the bidding process of contracts worth RM2 billion across industries.
On 1 November 2023, the Federal Court (the apex court in Malaysia), presided over by YAA Tan Sri Abang Iskandar Abang Hashim (President of the Court of Appeal) and hearing together with YA Datuk Zabariah Mohd Yusof and YA Datuk Harmindar Singh Dhaliwal, unanimously dismissed the Malaysia Competition Commission’s (“MyCC”) application under Rule 137 of the Rules of the Federal Court 1995 to review an earlier decision made by the Federal Court.
On 2 October 2023, the High Court delivered its full written grounds to quash the proposed decision of Malaysia Competition Commission (“MyCC”) dated 23 September 2019 against Grab Inc. and its subsidiaries, MyTeksi Sdn. Bhd. and GrabCar Sdn. Bhd. (collectively, “Grab”) (“Proposed Decision”) on grounds of procedural impropriety and breach of natural justice.
On 19 September 2023, the Competition Appeal Tribunal (“Tribunal”) delivered its decision in respect of the first bid rigging case under Section 4 of the Competition Act 2010 (“Act”) in Malaysia.
